WEBSITE TERMS 

The terms “we”, “us”, and “our” refer to Mother'z Yoga & Wellness(MYW). These Terms of Service apply when you visit or use the Business website (motherzyoga.com), social media channels, videos on YouTube and related platforms.

The term “user,” “you” and “your” refers to site visitors and users of the sites and customers of our Products. 

1. Acceptance of Terms

By using the Site, you agree to these Terms of Service and our Privacy Policy. If you do not accept the terms of this Agreement, you should discontinue use of the Website/Service immediately.

We may terminate your use of our website and services immediately if you breach any terms and conditions. 

We reserve the right to change these Terms of Service or to impose new conditions on use of the Site, from time to time, in which case we will post the revised Terms of Service on this website. By continuing to use the Site after we post any such changes, you accept the Terms of Service, as modified.

You must be 18 years or older to use our website and services.

 

2. Accessing the site and products

• Registration Information 

While using the Service, you agree to: (a) provide true, accurate, current and complete information about yourself in any of our opt-in or signup forms and (b) maintain and promptly update your Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect so, MYW reserves the right to suspend or terminate your account and refuse the use of the Service at any time.

• Member Account, Password and Security

While creating an account, you will be required to choose a password and user name. You are responsible for maintaining the confidentiality of your password and account information, and are fully responsible for all activities that occur under your password or account.
MYW will not be liable for any loss or damage arising from your failure to comply with this Agreement. MYW also reserves the right to cancel any membership it believes has been compromised, or is being used fraudulently, at its own discretion.

• Use of content

  You agree that all content on our website, is owned or licensed by us.  You must only use the website and its content “as is” for your information and personal use only and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of MYW. 

We reserve the right to modify, suspend or discontinue, whether temporarily or permanently, the Sites (or any part thereof) or Products, for any reason and without notice. You agree that MYW shall not be liable to you or to any third party for any modification, interruption, suspension, or discontinuance of the Sites and/or Products.

• Errors, inaccuracies, and omissions

Information provided about or in the Sites and/or Products is subject to change. We make no representation or warranty that the information provided, regardless of its source, is accurate, complete, reliable, current, or error-free. MYW disclaims all liability for any inaccuracy, error, or incompleteness in the Sites and/or Products.

• Third party links and advertising on our sites and products

We may provide links to other websites or resources, which are not maintained by or related to us. Links to such sites are provided as a service to our users and customers and are not sponsored by, endorsed, or otherwise affiliated with the Company. Any use of those sites is at your sole risk and you must direct any concerns regarding their products or services to the relevant third party. 

 

3. Health Disclaimer

Yoga in all of its forms and with or without the use of equipment such as blocks, bolsters or straps can be a strenuous physical activity. In some cases this can cause physical strain or injury. By signing up for the program you acknowledge you are fully aware of the risks and hazards involved. 

You also understand that it is your responsibility to check with your healthcare provider before engaging in any physical fitness routine.

We do NOT provide medical advice.

This site offers health, wellness, fitness, and nutritional information and is designed for educational purposes only. You should not rely on this information as a substitute for, nor does it replace, professional medical advice, diagnosis, or treatment. The use of any information provided on this site is solely at your own risk.

 

4. Use of testimonials and reviews

You agree that the MYW has the right to use your feedback whether in the form of emails, submissions, surveys, comments, discussions on the Sites and/or Product-related forums, calls, or otherwise, for the purposes of marketing or promoting the MYW Sites and/or Products.

5. Limitation of liability and indemnity

We exclude, to the maximum extent permitted by law, any liability in connection with your use of our website and its content. We are not responsible for any Loss or damage suffered in connection with your use of our website, its content, your reliance on any advice and information, any interruptions, changes, suspension or termination of our website or any events beyond our control. 

You indemnify us for any Claim arising out of or in connection with any third party links, websites, apps, software, products and services; your breach of these terms and conditions, your breach of the law including your local laws, or your breach of the rights of a third party. 

 

6. Other

This Agreement is governed by the Law of Victoria, Australia. You submit to the non-exclusive jurisdiction of its courts and courts of appeal from them. You will not object to the exercise of jurisdiction by those courts on any basis.
